The Sport and Health Clinic respects your privacy. This policy explains what personal and health information we collect, why we collect it, how we look after it, and what you can do if you want to see it, correct it, or raise a concern.

We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles. As a health service provider in New South Wales, we are also bound by the Health Records and Information Privacy Act 2002 (NSW) and the Health Privacy Principles.

What information we collect

Health information is treated as sensitive information under the Privacy Act, which means it carries a higher level of protection than ordinary personal information.

Personal details

Your name, date of birth, address, phone number, email address, emergency contact, and your Medicare, health fund or private insurance details.

Health information

Your medical history, the symptoms you describe, the results of any examination we carry out, our clinical notes, the treatment we provide, and any scans, X-rays or reports you give us or that we receive on your behalf.

Claim information

If you are claiming through WorkCover NSW or a Medicare chronic disease management plan, we collect your claim number and your employer, insurer or referring doctor's details.

Website information

If you use our contact form, our online booking system, or our careers form, we collect the information you enter. We also collect basic technical information about your visit, which is described in the website section below.

Why we collect it

We collect your information so we can provide you with chiropractic care safely. In practice that means assessing you, deciding whether treatment is appropriate, providing that treatment, keeping accurate records of it, and following up with you.

We also use it to process your health fund, WorkCover or Medicare claim, to contact you about your appointments, to meet our legal and professional obligations as a registered health practitioner, and to manage the day to day running of the practice.

We will not use your information for marketing without your consent, and you can withdraw that consent at any time by contacting us.

How we collect it

Wherever possible we collect information directly from you, in person, over the phone, through our website, or through our online booking system.

Sometimes we receive information about you from someone else, for example a referring GP, a specialist, a radiology practice, or your insurer. Where that happens and you would not reasonably expect it, we will let you know.

Who we share it with

We do not sell your information, and we do not share it for marketing purposes.

We may share your information with other health practitioners involved in your care, but only with your consent, or where the law allows or requires it. That includes your GP, a specialist we refer you to, or a radiology or pathology provider.

We may also share it with your health fund, Medicare or your insurer in order to process a claim, with our professional indemnity insurer or legal advisers if there is a claim or complaint, and with government agencies or a court where we are legally required to do so.

We may disclose information without your consent where we reasonably believe it is necessary to lessen or prevent a serious threat to someone's life, health or safety, as permitted under the Privacy Act.

The systems we use

We use a practice management and online booking system to manage appointments and clinical records. Information you enter when booking online is stored in that system.

We use HiCaps to process health fund claims at the counter. Claim information passes to your health fund through that terminal.
We may also use third party providers for services such as website hosting, email, appointment reminders and accounting. These providers only receive the information they need to perform their service for us, and they are required to protect it.

Where a provider stores information outside Australia, we take reasonable steps to ensure they handle it in a way that is consistent with the Australian Privacy Principles.

How we protect your information

We take reasonable steps to protect your information from misuse, loss, and unauthorised access, modification or disclosure. That includes secure electronic records with access limited to authorised staff, physical security for any paper records, secure disposal of records we no longer need, and staff who are trained on their privacy obligations.

If we experience a data breach that is likely to cause you serious harm, we will notify you and the Office of the Australian Information Commissioner, as required under the Notifiable Data Breaches scheme.

How long we keep your records

We are required to keep health records for a minimum period set by law. Where you were an adult at the time of treatment, we keep your records for at least seven years from the date of your last visit. Where you were under 18 at the time, we keep your records until you turn 25.

We may keep records for longer where we are required or permitted to do so, for example while a claim or complaint is on foot. When records are no longer required, we destroy or de-identify them securely.

Seeing and correcting your information

You can ask to see the information we hold about you, and you can ask us to correct it if it is wrong, out of date or incomplete. Please put your request in writing using the contact details at the bottom of this page.
We will respond within a reasonable time. We may charge a reasonable fee to cover the cost of locating and copying your records, and we will tell you what that is before we proceed.

In some limited situations the law allows us to refuse access, for example where giving it to you would pose a serious threat to someone's life or health, or would unreasonably affect another person's privacy. If we refuse, we will explain why in writing and tell you how the decision can be reviewed.

Our website

When you visit our website we may collect standard technical information such as your IP address, the type of device and browser you are using, the pages you visit, and the date and time of your visit. We use this to keep the site working properly and to understand how it is being used.
